Collection and processing of your personal data

When you visit our websites, we store different information about browser and operating system you use, date and time of your visit, the access result (if you were able to access this side or received an error), the search terms you may have entered, the functions of the website you used, the website from which you accessed our side as well as the website you visit after you leave our website by clicking on links on our website.
This data is used for statistical information to improve our internet presence and adapt it to your needs.

For security reasons we also store your IP-address and internet service provider to prevent and detect potential attacks on our website or any attempts of fraudulent activities.

Other personal information is only processed if you provide this data to us, e.g. via contact form, and is solely used for the intended purpose.

All collected data are only used within affiliated companies of the BENTELER group and will never been given to third parties without your explicit consent.

Analysis of usage data and use of analysis tool

The BENTELER Group uses the following tools to analyze your activity on our website:

    The operating mode “Universal Analytics” is used to assign data, sessions and interactions cross-device to a pseudonymous user ID and thus to investigate the activities of a user on different devices.
    Google Analytics uses so termed "cookies", text files that are stored on your computer and enable analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the US and stored there.
    • Protection of your personal data
      The IP anonymization feature has been activated for Google Analytics to protect your personal data, ensuring that no connection to a particular user can be established. Your IP will be abbreviated by Google within the member states of the European Union or in other states that are members of the European Economic Area before being sent to a server. Only in exceptional cases the full IP-address will be transferred to a server in the US and abbreviated there.
    • Purpose of processing
      As assigned by the responsible, Google will use this information in order to evaluate your use of the website, to collate reports on website activities and to provide further services to the website manager related to use of the website and of the Internet.
      Reports are compiled for BENTELER on your website activity so as to be able to adapt the Internet site to your needs.
    • Duration of data storing
      After 14 months, the data sent by us and linked to cookies, user IDs (eg user IDs) or advertising IDs will be automatically deleted. The deletion of data whose retention period has been reached is done automatically once a month.
    • Objection to tracking web analysis (opt out)
      You can prevent the storage of all cookies through the relevant adjustment of your browser software. HubSpot

We use HubSpot for marketing activities on our websites. HubSpot is a US company with an office in Germany, Am Postbahnhof 17, 10243 Berlin ("HubSpot"). We use HubSpot's integrated software solution for our own marketing, lead generation, qualification and management processes. This includes email marketing, which governs the sending of automated, individualized mailings, social media publishing and reporting, contact management such as user segmentation and CRM, landing pages and contact forms. Our contact forms allow you, as a visitor to our website, to learn more about our company, download content, and provide us with your contact information. This information, as well as our website content, is stored on HubSpot servers. We use this information to contact you. Before we process your information for the purposes set forth in this section, we obtain your consent to use HubSpot. You can revoke this consent at any time for the future in accordance with Art. 7 (3) DSGVO. If you have allowed us to contact you by email via a contact form, each email will contain an unsubscribe link.

HubSpot uses cookies. HubSpot collects and stores usage data in pseudonymous profiles to enable interest-based advertising. In addition, HubSpot evaluates information collected on our behalf so that we can generate reports about the visit and the pages visited. You can deactivate the storage of data by HubSpot in cookies and the associated recording of your user behavior by preventing the storage of cookies accordingly at any time through your browser settings and/or deleting existing cookies.

We use HubSpot to optimize advertising and customer targeting. Only if you have given us your consent to do so, we can also combine the pseudonymous data with personal information from your profile in order to address you optimally and provide you with interest-based support.

HubSpot Inc. is contractually bound to data protection-compliant processing by concluding a contract based on the EU standard contractual clauses. The consent you have given also relates to data transfers to the USA, as HubSpot uses sub-processors in the USA, including HubSpot Inc. The USA does not offer a level of data protection comparable to the European Union. In certain cases, U.S. companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) may process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. We process your contact data that you have provided to us via a lead gen form, contact form on our website or a special landing page until you revoke it, unless there is another legal basis for retention after your revocation.

LinkedIn Ads, LinkedIn Analytics and LinkedIn Marketing Solutions

We use the services of LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland ("LinkedIn"). As part of these services, LinkedIn collects and stores usage data in pseudonymous profiles to enable statistical analysis of website usage and the success of ads, as well as interest-based advertising on LinkedIn and LinkedIn partner sites. If you are a user of LinkedIn, LinkedIn may also merge the data with your user account. With LinkedIn Marketing Solutions, LinkedIn transmits personal data to us using a form (so-called LinkedIn Lead Gen Forms). Lead Gen Forms are forms already pre-filled with LinkedIn profile data that allow members to submit their data, which is publicly visible on the network, with just a few clicks. Requests generated through the forms are passed directly to our lead management tool, HubSpot. In addition, the data may be processed on LinkedIn servers in the USA. The deactivation is usually stored by means of a cookie. Therefore, it must be renewed when you delete the cookies. In addition, the deactivation must be performed separately for each browser.

Transfer of personal data to third parties; social plug-ins

BENTELER use social plug-ins on our websites from social networks like Facebook, Twitter and LinkedIn. When you visit our websites the social network plug-ins are deactivated, therefore no data is transmitted to the network. If you want to use one of the networks, you have to clock on the respective plugin to establish a connection. If you have user account on those networks and you are logged in when you visit our website, the network can associate you’re your visit with your user account. To avoid this, please log out before you visit our website.

When you activate a social plug-in, the network transfers the available content to your browser, which integrates it into our websites. In this situation, data transmissions can also take place that are initiated and controlled by the respective social network. The data transaction taking place between your system and the social network is only governed by the privacy policy of the respective network.

As long as you do not delete or deactivate cookies, the social plug-in remains active.

BENTELER itself will never transfer your personal data to third parties without your knowledge and consent.

 

Contact with BENTELER (Contact form or e-mail)

If you contact us via contact form or via E-Mail we will safe your data for handling reasons or for follow-up question for six months. Those data are only used within the BENTELER Group and will not be forwarded to any third party.

 

Data security and protection of your personal data

The BENTELER Group employs technical and organizational measures to protect your personal data stored by us against accidental or willful manipulation by unauthorized persons. Our security measures are continuously adapted to the technical development.

Your personal information is only stored and used by the companies of the BENTELER Group if you make it available to us. BENTELER will never amalgamate website tracking or other non-personal data with data from other sources without your explicit consent.

Please note that we cannot guarantee the confidentiality of sensitive personal data which you send us via unencrypted e-mail or Internet connection as against third parties.


 

Legal basis of data processing

Insofar as you have given us your consent for the processing of your personal data, that consent is the legal basis for the processing (Art. 6 para. 1 letter a GDPR).
In addition, we process personal data for the purposes of safeguarding our legitimate interests and the legitimate interests of third parties pursuant to Art. 6 para. 1 letter f GDPR. Maintaining the functionality of our IT systems, marketing our own products and services as well as documenting business contacts as required by law are such legitimate interests.
In case of legal requirements we process also data based on Art. 6 para. 1 letter c GDPR.

 

Data processing by third parties

The BENTELER Group involves external service providers in the data processing. BENTELER requires of these companies that the personal data accumulated in the processing is used exclusively for the intended purpose, and that adequate protection of the data is ensured in accordance with the locally applicable data protection regulations. Contracts with external providers will always fulfill the needs of Art. 28 of GDPR if there is access or processing of personal data.

 

Your rights

Based on article 15 to 18 and 20 of GDPR you have the right of information, correction, deletion, restriction, revocation and contradiction of your personal data.

If you have consented to the processing of your personal data, you have the right to revoke your consent at any time for future use. The legality of processing before revocation remains unaffected. We may further process such data pursuant to another applicable legal basis, e.g. for the fulfilment of our legal obligations.

In accordance with the existing legal provisions, on request, the companies of the BENTELER Group will inform you in writing whether and which of your personal data is stored by us. If, despite our endeavors, incorrect information of yours is stored by us, we will amend, block or delete this on your request if there is no need for the fulfilment of other legal obligations.
